A CAUTIONARY TALE FOR ANYBODY THINKING OF HIRING THEM
The story so far.
NOTHING IN RETURN FOR $15,000. On April 20 2009 Tom contracts with Brand Studio (owned by Sefton Billington) to develop a new Internet store. Brand Studio plan to complete the work and GO LIVE on July 13 2009.
April 23 - Deposit invoice - $4,095
May 12 - 1st progress payment - $3,375.00
June 22 - 2nd progress payment - $3,375.00
July 10 - 3rd progress payment - $3,375.00
Total payments thus far: $14,420.00
Apparent progress so far: ZILCH

Thank you for your reply. I have certainly realised that this more difficult than you envisaged. It would be a good idea to let me know which function/s is/are not working. If I knew what wouldn’t work I could think about what I could do without or change. Remember that if there is a problem you just cannot crack, I am prepared top discuss a workaround.

Hi Tom.
Sorry about the delayed reply I just got your message.
We apologise about the time-frame in the getting the final project online and thank you for your patience.
We have been going through all the outstanding issues but it has turned out more complex than we first thought.
Fixing one problem seems to generate 2. However we are progressing slowly and should be sorted before the New Year.
We will ensure that we keep you better in the loop.

I am as good natured and patient a person as you are likely to meet. However, this has gone on too long now and I need a resolution. The options are:
The job gets finished by the end of the year and I get my new system.
- You tell me that you are unable to complete by then and we sit down to discuss what can be done to produce a working system of some sort in an acceptable timeframe.
- You tell me that you are unable to complete by then and are unwilling to involve me in reaching a solution. We then discuss an exit strategy.
This new system is important to me and I want to move on from this interminable waiting. I will no longer be left on the sidelines. I can envisage several potential scenarios for progression:
- You complete by year’s end.
- You tell me you can’t do it and we discuss alternatives that are achievable in a reasonable timeframe.
- You tell me you can’t do it and provide what you have done. I find someone else to complete.
- If it proves to be too hard, I can review the specs and modify them to something that can be achieved.
- I can abandon the whole thing and start again with someone else (somewhat wiser this time).
I am reasonable, realistic and a good problem solver. I need to be in the loop on this one as of now. Please consider the options above and either let me know which might work best for you or suggest something else that might. I would like an answer without delay and a commitment from you to resolve this unsatisfactory situation one way or the other by an agreed time.
